General Terms and Conditions of Sale

These Terms of Service ("Terms") govern your access to and use of the website www.vildnord.com and all related localized domains (collectively, the "Website"), as well as any purchases you make from us.

"Order": A request by the Customer to purchase Products from Vild Nord.

"Subscription": A recurring order arrangement where Products are delivered at regular intervals.

"Services": All services provided through the Website, including purchasing, account management, and customer support.

3. Eligibility

To use our Website and purchase Products, you must:

4. Account Registration

4.1 Access your Account

To access your Account, a secure one-time login code will be sent by email to the email address associated with your account each time you sign in. You may also access certain account features through the Shop app. When creating an Account, you agree to:

Maintain and promptly update your information
Notify us immediately of any unauthorized access to your Account

4.2 Account Security

You are responsible for all activities that occur under your Account. We are not liable for any loss or damage arising from unauthorized use of your Account. We reserve the right to suspend or terminate Accounts that violate these Terms.

5. Products

5.1 Product Information

We strive to provide accurate descriptions, images, and pricing for all Products. However, we do not warrant that Product descriptions, images, pricing, or other content on the Website are accurate, complete, reliable, current, or error-free.

5.2 Dietary Supplements

Our marine collagen products are classified as dietary supplements (food supplements). Please note:

Dietary supplements are not intended to diagnose, treat, cure, or prevent any disease
Results may vary from person to person
Supplements should not replace a varied and balanced diet and healthy lifestyle
Consult a healthcare professional before use if you are pregnant, breastfeeding, taking medication, or have a medical condition
Do not exceed the recommended daily dose
Keep out of reach of children

5.3 Allergen Information

Our Products contain fish (cod). Some Products may contain traces of crustaceans and mollusks due to shared production facilities. If you have food allergies, please review ingredient lists carefully and consult your healthcare provider before use.

5.4 Storage

Store collagen powder in a cool, dry place away from direct sunlight at maximum 25°C.

To ensure optimal product quality, this product should be consumed within three (3) months after opening. Although collagen is inherently stable, storage conditions after opening may affect the product's taste, smell, solubility, and overall quality over time. As Vild Nord cannot control the handling and storage conditions of products after opening, this recommendation serves as a precautionary measure and forms part of our Terms and Conditions of Sale.

6. Orders and Pricing

6.1 Placing an Order

When you place an Order through the Website, you are making an offer to purchase Products. We will send you an order confirmation email acknowledging receipt of your Order. This confirmation does not constitute acceptance of your Order.

A binding contract is formed only when we dispatch your Order and send you a shipping confirmation. We reserve the right to refuse or cancel any Order for any reason, including but not limited to:

Product availability issues
Errors in pricing or Product information
Suspected fraudulent activity
Inability to verify payment information

6.2 Pricing

All prices displayed on the Website are inclusive of applicable VAT for your location. Prices are displayed in the currency corresponding to your selected country. We reserve the right to change prices at any time without prior notice, but changes will not affect Orders already confirmed.

6.3 Payment

We accept the following payment methods:

Credit/Debit Cards: Visa, Mastercard, Maestro, American Express
Digital Wallets: Apple Pay, Google Pay, PayPal

Payment is processed securely through our payment service providers. We do not store your full payment card details. By providing payment information, you represent that you are authorized to use the payment method.

7. Shipping and Delivery

7.1 Shipping Destinations

We currently ship to: Denmark, France, Germany, Italy, Belgium, Netherlands, Luxembourg, Monaco, Norway, and Sweden. Shipping availability and costs vary by destination.

7.2 Delivery Times

All delivery times are expressed in business days. For country-specific delivery times, shipping methods, and delivery conditions, please refer to our Shipping Policy.

7.3 Shipping Costs

Shipping costs are calculated at checkout based on your location and order value. Free shipping may be available for orders exceeding certain thresholds.

7.4 Risk of Loss

Risk of loss and title for Products pass to you upon delivery to the carrier. However, for consumer purchases within the EU, risk passes to you when you (or a third party indicated by you) physically acquires the Products.

8. Subscriptions

8.1 Subscription Service

We offer subscription services for recurring delivery of Products. When you subscribe, you authorize us to charge your payment method automatically at the selected frequency until you cancel.

8.2 Managing Your Subscription

You can manage your subscription through your Account, including:

Skipping deliveries
Updating payment or shipping information
Pausing or cancelling your subscription

8.3 Cancellation

You may cancel your subscription at any time before the next billing date. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

9. Right of Withdrawal (EU Consumers)

9.1 Withdrawal Period

If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you (or a third party indicated by you) acquires physical possession of the Products.

9.2 Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement sent to:

9.3 Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except for additional costs if you chose a delivery method other than the least expensive standard delivery). We will make the reimbursement within 14 days from the day we receive the returned Products or proof of return, whichever is earlier.

9.4 Return Conditions

Products must be returned:

In their original packaging, unopened and unused
Within 14 days of notifying us of your withdrawal
At your own cost unless the Products are defective

You are liable for any diminished value of the Products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Products.

9.5 Exceptions

The right of withdrawal does not apply to:

Products that have been opened or unsealed after delivery (for hygiene reasons)
Products that are liable to deteriorate or expire rapidly
Products made to your specifications or clearly personalized

11. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, product descriptions, software, and the compilation thereof, is the property of Vild Nord or its licensors and is protected by Danish and international copyright, trademark, and other intellectual property laws.

You may not:

Copy, reproduce, distribute, or create derivative works from our content
Use our trademarks without prior written consent
Remove or alter any proprietary notices on our content
Use automated systems to access or scrape the Website

The Vild Nord name, logo, and all related product names are trademarks of Vild Nord Danmark ApS.

12. User Conduct

When using our Website, you agree not to:

Violate any applicable laws or regulations
Infringe on the rights of others
Submit false, misleading, or fraudulent information
Upload or transmit viruses, malware, or other harmful code
Attempt to gain unauthorized access to our systems

13. Affiliate Program

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) defective products under applicable product liability laws; or (d) any other liability that cannot be excluded or limited by law.

For EU consumers, these limitations do not affect your statutory rights under applicable consumer protection laws.

15. Indemnification

You agree to indemnify, defend, and hold harmless Vild Nord, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

Your violation of these Terms
Your violation of any applicable law or third-party rights
Your use of the Website or Products
Any content you submit or transmit through the Website

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, supply chain disruptions, pandemics, or technical failures.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles. For EU consumers, this choice of law does not deprive you of the protection afforded by mandatory consumer protection laws of your country of residence.

17.2 Dispute Resolution

We encourage you to contact us first to resolve any disputes amicably. If a dispute cannot be resolved, EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform at:

Any legal proceedings shall be brought before the competent courts in Copenhagen, Denmark, unless otherwise required by applicable consumer protection laws.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Material changes will be communicated via email to registered users. Your continued use of the Website after changes become effective constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy, constitute the entire agreement between you and Vild Nord regarding your use of the Website and purchase of Products, superseding any prior agreements.
